Swain County Board of Elections Response to Clampitt Challenges PDF Print E-mail

In a prliminary hearing held 11:00, Wednesday, May 23, 2007 at the Swain County Adminstration building, the Swain County Board od Elections found enough evidence of probable cause brought to them by Mike Clmapitt, Chairman of the Swain county Republican Party, to schedule a hearing at 10:00 a.m., Wednesday, September 19, 2007 at the Swain County Board of Elections. The challenges' evidence Mr. Clampitt brought before the Board were first class mail envelopes returned to him of a group of individuals that had registered to vote in Swain County claiming 502 OJCC Rd. as their residence on their voter registration cards, which does not meet NCGS 163-57 (11) "Residence defined for the registration and voting".  According to Clampitt "these individuals are students, temporary instaying there and do not meet the domicle requirment of the statute". Stateing further case law was the Hall vs. Wake County Board of Election in North Carolina Supreme Court, that Mr. Clampitt Contended at an earlier preliminary hearing, but, the Swain County Board of Elections in a 2 to 1 vote dismissed the challenges citing "lack of evidence". The hearing is scheduled in accordance to North Carolina General Statute 163-86 "Hearing on challenge".  As part of the hearing process Mr. Clampitt requested the Chairman, Mr. Russell Childers to subponea the Director of Job Corps, the Postmaster of the Cherokee Post Office,and Mail Route Carrier to the OJCC Rd. address. Mr. Childers advised Mr. Clampitt that he would have to get back with him as per those requests. Mr. Clampitt requested the Chairman to respond with an answer by Wednesday, May 30, 2007. "That could be possible ", Mr. Childers said. With nothing further the hearing adjourned.
